The Yu-Gi-Oh! Duel Links 4th Anniversary Tournament

Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. Tournament may only be entered in or from the 50 United States, the District of Columbia and Canada (except for the province of Quebec) and entries originating from any other jurisdiction are not eligible for entry.  This Tournament is governed exclusively by the laws of the United States. You are not authorized to participate in the Tournament if you are not located within the 50 United States, the District of  Columbia or Canada. 

1. How to Enter. The influencers listed below (each an “Influencer”) will post Tournament times (each an “Entry Period”) to their Instagram and/or Twitter  accounts on or about February 11, 2021. For a chance to enter the Yu-Gi-Oh! Duel Links 4th Anniversary Tournament (“Tournament”) log onto the Yu-Gi-Oh! Twitch.tv channel at Twitch.TV/OfficialYUGIOHChannel (the “Channel”) on February 11, 2021 during the Entry Period. A Tournament moderator will randomly select viewers logged into the Channel during the Entry Period to participate in the Tournament.

The Yu-Gi-Oh! Duel Links (the “Game”) is available for download at the Apple App Store, Google Play, and Steam. You must download the Game to participate in the Tournament. All entrants must have a valid email address, Duelist ID, and active TWITCH.TV account, and must provide Sponsor (or parties acting on behalf of Sponsor) with entrant’s first and last name prior to participation.

If you enter using your mobile device, standard data fees may apply.  You should consult your wireless service provider's pricing plan for details. You agree to incur any and all charges demanded by your wireless carrier.
All entry information, including any audio and/or video appearance on Twitch.tv in connection with entrant’s participation in the Tournament, shall be collectively referred to herein as the “Submissions” or each as a “Submission.”  By entering, each entrant warrants and represents the following with respect to entrant’s Submission: (a) entrant is the sole and exclusive owner of the Submission; (b) the Submission will not infringe on any rights of any third parties; and (c) any third parties appearing in the Submission have given entrant appropriate consent to be photographed or filmed and used as permitted herein. Sponsor reserves the right to request releases from any third parties appearing in any Submissions at any time.  Failure to produce third party releases upon Sponsor’s request may result in disqualification, as determined by Sponsor is its sole and absolute discretion.

Limit one (1) Duel/entry per person. If you are not selected by the Tournament moderator to participate in the Tournament during an Entry Period, you may log in during another Entry Period for a chance to participate in the Tournament.  No automated entry devices and/or programs permitted.  All terms and conditions of Twitch.tv apply. All entries become the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned. Delivery of prizes requires a street address (no P.O. Boxes).  Sponsor is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic.  Only fully completed entry surveys are eligible.  Proof of Submission will not be deemed to be proof of receipt by Sponsor. 

2. Start/End Dates. Tournament begins at 3:00:00 PM United States PST on February 11, 2021 and ends at 8:30:00 PM United States PST on February 11, 2021.           

3. Eligibility. Participation open only to legal residents of the 50 United States, the District of Columbia, and Canada (except for the province of Quebec) who are at least thirteen (13) years old as of date of entry. Those under the age of majority must have their parent or legal guardian’s consent and agreement to these Official Rules before entering. Void outside of the 50 United States, the District of Columbia, and Canada, and where prohibited, taxed or restricted by law.  Employees, officers and directors of Konami Digital Entertainment Inc.  (“Sponsor”) and Damage LA LLC (“Administrator”), and its and their parent companies, subsidiaries, affiliates, partners, advertising and promotion agencies, manufacturers or distributors of Tournament materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees/officers/directors are not eligible to enter.  Tournament may only be entered in or from the 50 United States, the District of Columbia, and Canada (except for the province of Quebec), and entries originating from any other jurisdiction are not eligible for entry.  You are not authorized to participate in the Tournament if you are not located within the 50 United States, the District of Columbia, or Canada (excluding Quebec).  All federal, state/provincial/territorial and local laws and regulations apply.

4. Random Drawings; Tournament Phases.
There will be two (2) phases of the Tournament (each a “Phase”). Each with prizing as outlined in this Section 4 and Section 5 below.

Phase 1.  In a random drawing from all eligible entries submitted during the applicable Influencer’s Entry Period, an initial six (6) entrants will be selected (“Phase 1 Players”) to participate in Phase 1 of the Tournament and Duel the applicable Influencer in the Game. (Six (6) Phase 1 Players per Influencer, eighteen (18) Phase 1 Players in total, will be selected.)  The duration of Phase 1 shall be ninety (90) minutes per Influencer. If time permits, and the initial selected Phase 1 Players have completed gameplay against the Influencer, Sponsor’s Tournament moderator will continue to randomly draw additional players from the remaining eligible entries. Three (3) of the participating Phase 1 Players who beat their Influencer at the Game (“Phase 1 Winners”) will advance to Phase 2 to Duel Virtual Seto Kaiba.


If more than three (3) participating Phase 1 Players beat the applicable Influencer, then among the Phase 1 Winners, the top three (3) Phase 1 Winners, based on the ranking criteria in the following order will advance Phase 2

1st Ranking: Duelist with the Highest Life Points at End of Duel
2nd Ranking: Lowest Total Turn Count
3rd Ranking: Highest Number of Cards Played

Duelists will be ranked based on how low they can get the Influencer’s life points down at the end of the Duel. If in the event more than 1 Duelist ties, then the highest total turn count will be considered. In the event two or more Duelists have the same total number of turns and lowest influencer’s life points, the tie breaker will be the highest number of Cards played.

Phase 1 Winners not selected based on the ranking criteria to Duel Virtual Seto Kaiba, will be automatically entered into a random drawing for a chance to win the Phase 1 Prize. Such drawing to take place on or about on or about February 12, 2021 at 6:15:00 PM United States PST.

In the event less than three (3) participating Phase 1 Players beat their Influencer at the Game, the top three (3) Phase 1 ranked players, based on the ranking criteria in the following order will advance to Phase 2.

1st Ranking: Winner
2nd Ranking: Lowest Influencer’s Life Points at End of Duel
3nd Ranking: Highest Total Turn Count
4th Ranking: Highest Number of Cards Played

Duelists with the highest life points will rank highest. If two or more Duelists have the same amount of life points, then the Duelist who defeats the Influencer in the shortest total number of turns will rank highest. If two or more Duelists have the same total number of turns and life points, the tie breaker will be the highest number of Cards played.

Those players selected to advance to Phase 2 to Duel against Virtual Seto Kaiba in Phase 2 of the Tournament will be referred to as “Phase 2 Players.”  Three (3) Phase 1 Players per Influencer, nine (9) in total, will be selected and advance to Phase 2 as Phase 2 Players. 

Phase 2. On or about February 12, 2021 nine (9) Phase 2 Players will log into the Channel at 3:00PM PST United States to Duel against Virtual Seto Kaiba in Phase 2 of the Tournament.

Three (3) of the participating Phase 2 Players who beat Virtual Seto Kaiba at the Game (“Phase 2 Winners”) will win the Grand Prize.

If more than three (3) participating Phase 2 Players beat Virtual Seto Kaiba at the Game, the top three (3) Phase 2 Winners, based on the ranking criteria in the following order will win the Grand Prize.

1st Ranking: Duelist with the Highest Life Points at End of Duel
2nd Ranking: Lowest Total Turn Count
3rd Ranking: Highest Number of Cards Played

Duelists with the highest average life points in their victories over Virtual Seto Kaiba will rank highest. In the event that more than one Duelist ties, then the Duelist who defeats Virtual Seto Kaiba in the shortest total number of turns will rank highest. If two or more Duelists have the same total number of turns and life points, the tie breaker will be the highest number of Cards played.

In the event less than three (3) participating Phase 2 Players beat Virtual Seto Kaiba at the Game, the top three (3) Phase 2 ranked players, based on the ranking criteria in the following order, will win the Grand Prize.

1st Ranking: Winner
2nd Ranking: Lowest Virtual Seto Kaiba’s Life Points at End of Duel
3nd Ranking: Highest Total Turn Count
4th Ranking: Highest Number of Cards Played

Duelists will be ranked based on who was able to get Virtual Kaiba’s life points the lowest. In the event that more than one Duelist ties, then the Duelist having the highest total number of turns will be ranked the highest (which is defined as the total number of turns they lasted in the Duel against Virtual Kaiba).  If two or more Duelists have the same total number of turns and lowest Virtual Kaiba’s life points, the tie breaker will be the highest number of Cards played.

Phase 2 Players who do not win the Grand Prize, will be awarded the Phase 2 Prize.

Odds of winning depend on the number of eligible entries received for the drawings.  Drawing will be conducted by Waveform and Damage LA LLC.  By entering the Tournament, entrants fully and unconditionally agree to be bound by these rules and the decisions of the judges, which will be final and binding in all matters relating to the Tournament.

5. Available Prize(s).

There are eighteen (18) prizes available to be won, as follows:

GRAND PRIZE:

Three (3) Grand Prize packages including an advance copy of the Yu-Gi-Oh! TCG Masterpiece Series: Platinum Blue-Eyes White Dragon Card (available Summer 2021) $1,000.00 USD $1,277.74 CAD each, KaibaCorp briefcase ($100.00 USD $127.77 CAD each), Yu-Gi-Oh! PHASE 2 PRIZE:

Duel Links Power Bank ($20.00 USD $25.55 CAD each), Yu-Gi-Oh! Duel links ZEXAL Coin ($20.00 USD $25.55 CAD each) and Yu-Gi-Oh! Duel Links Face Mask ($15.00 USD $19.17 CAD each). $1,110 USD  $1,418.30 CAD total.

PHASE 1 PRIZE:

Nine (9) Phase 1 Prizes of a limited edition Yu-Gi-Oh! Behold the Legendary Gods Glow-in-the-Dark Artwork print ($30.00 USD $38.33 CAD each). $270 USD $344.99 CAD total. 

Total approximate retail value of all prizes combined: $4,935 USD $6,305.67CAD. Prizes are non-transferable.  No substitutions or cash redemptions.  In the case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value. Unclaimed prizes will not be awarded. All unspecified expenses are the responsibility of winner(s). 

6. Notification. Winner(s) will be notified by email at the email address provided in Winner’s entry and will be required to sign and return, where legal, an Affidavit of Eligibility/Declaration of Compliance and Liability/Publicity Release within fourteen (14) days of prize notification. If any winner is considered a minor or under the age of majority in his/her jurisdiction of residence, Liability/Publicity Release must be signed by his/her parent or legal guardian and such prize will be delivered to minor’s parent/legal guardian and awarded in the name of parent/legal guardian. If any winner cannot be contacted within five (5) calendar days of first notification attempt, if any prize or prize notification is returned as undeliverable, if any winner rejects his/her prize or in the event of noncompliance with these Tournament rules and requirements, such prize will be forfeited and an alternate winner will be selected from all remaining eligible entries.  In the event any winner is a legal residence of Canada, he/she will be required to correctly answer a time-limited mathematical skill-testing question in order to be declared the winner.  Upon prize forfeiture, no compensation will be given.  Limit one prize per person.

7. Conditions. All federal, state, provincial/territorial and local taxes are the sole responsibility of the winner(s). Participation in Tournament  constitutes each entrant’s permission for Sponsor to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information and/or any statements made by each entrant regarding the Tournament  or Sponsor for advertising and promotional purposes without notice or additional compensation, except where prohibited by law. By participating, entrants and winner(s) (or entrant’s and winner’s parent/legal guardian where entrant is considered a minor / under the age of majority in his/her jurisdiction of residence) agree to release and hold harmless Sponsor, Damage LA LLC, Waveform,  each Influencer,  Apple Inc., Google LLC, Valve Corporation (Steam), Instagram, Facebook, Twitter, Twitch.tv, and its and their  affiliates, partners and promotion and advertising agencies and each of their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “Released Entities”), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in Tournament, or possession, acceptance and/or use or misuse of prize or participation in any Tournament -related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.  Sponsor is not responsible if Tournament cannot take place or if the prize cannot be awarded due to travel cancellations, delays or interruptions due to COVID-19, acts of God, acts of war, natural disasters, weather or acts of terrorism. Entrants who do not comply with these Official Rules, or attempt to interfere with this Tournament in any way shall be disqualified. There is no purchase or sales presentation required to participate. A purchase does not increase odds of winning.  

8. Additional Terms. In case of dispute as to the identity of any entrant, entry will be declared made by the authorized account holder of the email address submitted at time of entry. “Authorized Account Holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. Any potential winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the email address associated with the winning entry.  Any other attempted form of entry is prohibited; no automatic, programmed; robotic or similar means of entry are permitted. The Released Entities are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Tournament, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Tournament or downloading any materials in this Tournament.  Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Tournament should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Tournament. In such case, Sponsor may select the winner(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Tournament or web site.  Canada only: Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate or necessary to comply with applicable law. Sponsor may prohibit an entrant from participating in the Tournament or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Tournament by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE TOURNAMENT MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

9.  Limitation of Liability; Disclaimer of Warranties.  IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SERVICE AND/OR THE TOURNAMENT, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATES WITH THE TOURNAMENT. IN NO EVENT SHALL THE RELEASED ENTITIES’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED $100 USD ($127.77 CAD). WITHOUT LIMITING THE FOREGOING, THIS TOURNAMENT AND ALL PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS. IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE ANY AND ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF THE STATE OF CALIFORNIA, WHICH PROVIDES AS FOLLOWS:  “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

10. Disputes; Governing Law.  To the extent permitted by applicable law, by entering the Tournament, you agree that any and all disputes, claims, and causes of action arising out of the promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state court located in the County of Los Angeles, California, U.S.A. All issues and questions concerning these Official Rules, your rights and obligations, or Sponsor’s rights and obligations shall be governed by the laws of the State of California, U.S.A., without giving effect to any choice of law or conflict of law rules.
The parties agree not to raise the defense of forum non conveniens.

11. Use of Data.  Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy.  Please review the Sponsor’s privacy policy at https://legal.konami.com/kdeus/privacy/en-us/. By participating in the Tournament, entrants (or entrants parent/legal guardian where entrant is considered a minor/under the age of majority in his/her jurisdiction of residence) hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy. 

12. List of Winners/Winner’s Name. To obtain a list of winners/the name of the winner, send a self-addressed, stamped envelope by March 19th, 2021 to: Damage LA LLC, 225 S. Lake Ave. #300 Pasadena, CA 91101. Residents of Canada may omit the return postage.
